General Terms and Conditions
This contract sets out your legal rights and conditions. You agree to use the CYCLE CULTURE website (www.cycle-culture.com) only for purposes permitted by these Terms & Conditions and any applicable law, regulation, or generally accepted practices or guidelines in the relevant jurisdictions. You specifically agree not to access or attempt to access the Website, or any portion thereof, through any automated means, including but not limited to the use of scripts or web crawlers. You agree that you will not engage in any activity that disrupts or otherwise interferes with the Website (or the servers and networks which are connected to the Website). You agree that you will not duplicate, reproduce, copy, sell, trade, or resell the Website for any purpose. You agree that you are solely responsible for any breach of your obligations under these Terms & Conditions and for the consequences (including any loss or damage which CYCLE CULTURE may suffer) of any such breach. Photos on the website are for illustration purposes only. To obtain an accurate description of any product and its details, you should read the product description listed.
Terms of Service
You will be required to register with CYCLE CULTURE to access certain services or areas of the Site. With respect to any such registration, we may refuse to grant you the username you request. Your username and password are for your personal use only. If you use the Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password. In addition to all other rights available to CYCLE CULTURE, including those set forth in these Terms & Conditions, CYCLE CULTURE reserves the right, in its sole discretion, to terminate your account, refuse service to you, or cancel orders. We may from time to time modify or change the Terms and Conditions. The revised Terms & Conditions will govern your future use of our Site and Service, so we strongly suggest that you visit and review our Terms & Conditions periodically. Each version is specifically dated. If you do not agree to the revised version, you must immediately stop using our Site and Service. If you are under the age of eighteen (18) years, you cannot place orders with CYCLE CULTURE. By accepting these Terms & Conditions, you acknowledge that you are over the age of eighteen (18) years. Should CYCLE CULTURE suffer any damage or other losses as a result of a transaction entered into by a minor, CYCLE CULTURE reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with CYCLE CULTURE. In addition to these general terms and conditions, there are other important legal conditions concerning the Return policy and Cancellation policy. Agreeing to these general terms and conditions means your approval and your commitment to the return policy, which are all part of a legally binding contract between us and you. You must read these general terms and conditions and return policy carefully before buying anything from CYCLE CULTURE. We reserve the right to change the general terms and conditions and return policy at any time. Any changes in terms and conditions will apply to all new orders after posting the changes on the CYCLE CULTURE Website. You should review the general terms and conditions and return policy posted on the CYCLE CULTURE Website before each request. We have the right at any time to modify, stop selling, stop services, or sell any of our products, stop online shopping temporarily or permanently, with or without prior notice. In case our service stops after payment, we shall refund you, in accordance with the return policy. It is your responsibility to ensure the confidentiality of your login and password, and all other data related to your account at all times. You agree to notify us as soon as you know about any suspected or present risk to the security of your account.
Availability and Estimated Delivery Times
Although we constantly check the accuracy of our stock and its compatibility with the physical inventory in our warehouse, errors may occur. If we discover any stock error with any product you ordered, we shall inform you as soon as possible.
Payment
Payment for products from the website can only be made via card payments when the product is ordered. CYCLE CULTURE cannot accept any other form of payment. Our prices include statutory VAT of the UAE but are net of shipping costs. Shipping costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the ‘Grand Total’. Due to the nature of the clearing system, your debit card payment will be ‘authorized’ at the time of checkout. This will place a hold on the funds, and payment will be taken once the order is dispatched. If a problem in supply should occur, the authorization will be reversed and funds will be released back into your account within 3-5 days. The refund may take a couple of days to show as cleared funds on your account, depending on the payment provider. If a problem in supply should occur, funds will be refunded as swiftly as possible. If your delivery address is outside of the UAE, you may be required to pay import duties and taxes when your CYCLE CULTURE order reaches your country. These and any additional charges for customs clearance are your responsibility. All orders are fulfilled and dispatched from the UAE. If you are using a foreign credit or debit card, you should be aware that in some cases the banks may charge you for international transactions. CYCLE CULTURE is not responsible for any charges levied by banks. If you are using foreign credit or debit cards, you should also note that the amount charged to your credit or debit card will be the value of the product displayed in AED which is converted into the currency of your credit or debit card at the prevailing conversion rate by the banks. When you place an order for products, CYCLE CULTURE collects certain personal and transactional information (e.g., name, address, email address). For details on how CYCLE CULTURE uses this information please refer to CYCLE CULTURE privacy policy. CYCLE CULTURE accepts orders for products subject to availability. If for any reason the products you ordered are no longer available, CYCLE CULTURE will contact you using the contact details provided when placing the initial order and either: Offer you an alternative product of equivalent quality and price if this is possible, or; Cancel the product from your order and give you a full refund in respect of that product. If CYCLE CULTURE is unable to contact you or receive a response from you, CYCLE CULTURE will process any remaining products on your order and refund you for the products CYCLE CULTURE was unable to supply. CYCLE CULTURE retains the legal title to any product supplied by us until the purchase price, including VAT and shipping costs, are met for such product.
Refunds
Refunds will only be issued once the Returns policy has been completed and complied with. Please see our Returns policy. If an item is returned within the proper period and the correct channels of communication have been followed, then an item can be fully refunded. Items that have been outlined as unreturnable will not be able to receive a refund. If the item is approved for a refund, then it will be processed and a credit will automatically be applied to your credit card or original method of payment within 1 week. Any further delay may be caused by the processes of the banks or other such similar institutions. If there are any issues with your refund, then please contact your bank and/or card company to check the refund status. CYCLE CULTURE is not responsible for any fee the bank or card company may take during the refund process.
Cancellations
Orders may be canceled at any time before they are prepared by our team. Simply visit your account and follow the steps for a full refund. If the item has already been dispatched, then please see our returns policy. Once the order has been agreed and submitted, you forgo the right to cancel the product(s) if customized.
Governing Law
These Terms are governed by and construed in accordance with the laws in force in the UAE. You agree to submit to the non-exclusive jurisdiction of the courts of UAE.
User Reviews and Comments
You agree to comply with all legal requirements of the jurisdiction in which you are located with regards to your use of the Website and you acknowledge that you are entirely responsible for ensuring your own familiarity with such requirements and your own compliance with these requirements. Members are able to post comments, information, and other material (“User Content”) on the Website. You must not post User Content that is offensive, indecent, or objectionable or which denigrates any person or entity within the Website. You understand that the person who submits User Content is responsible for that User Content. In the same way, you are entirely responsible for the User Content that you make available to or through the Website. CYCLE CULTURE is not liable for any User Content. CYCLE CULTURE has the right (but not the obligation) to refuse, edit, or remove any User Content. Whilst CYCLE CULTURE intends to refuse, edit, or remove any User Content that is offensive, indecent, or objectionable, CYCLE CULTURE may not do so before you are exposed to such User Content. Please notify CYCLE CULTURE if you find User Content that is offensive, indecent, or objectionable. CYCLE CULTURE does not and cannot guarantee the accuracy, integrity, or quality of User Content. Additionally, CYCLE CULTURE is not liable for any loss or damage that you suffer because of your use of or reliance on the User Content. User Content may not be accurate – please make your own enquiries before relying on any User Content. Once you submit User Content to the Website, you grant CYCLE CULTURE a worldwide, royalty-free, and non-exclusive license to use and modify the User Content in any way in all media. Amongst other things, it may be included within the Website.
Liability
CYCLE CULTURE makes no warranties or representations of any kind concerning the accuracy or suitability of the information contained on the Website or that it is free from error. The information on the Website may contain technical inaccuracies or typographical errors. All liability of CYCLE CULTURE howsoever arising for inaccuracies or errors is expressly excluded to the fullest extent permitted by law. CYCLE CULTURE will not be liable for any damages arising out of or in connection with the use of the Website. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect, or consequential damages, loss of data, income, or profit, loss of or damage to property, and claims of third parties.
